Terms of Use

By accessing or using any website, platform, application, or service of AJUDA.DIGITAL LTDA, registered under CNPJ 55.080.297/0001-34, with its registered office at BR 470 — KM 176, nº 2492, Sala 04, Veranópolis/RS, CEP 95330-000 ("AJUDA.DIGITAL", "we" or "Company"), you fully agree to these Terms of Use ("Terms"). If you do not agree with any provision of these Terms, do not use our services. These Terms constitute a binding agreement between you ("User" or "you") and AJUDA.DIGITAL. The use of any service implies automatic and full acceptance of these Terms, our Privacy Policy, and any product-specific policies.

AJUDA.DIGITAL is a technology midwife company that operates an ecosystem of digital products, including but not limited to: • sentic.link — Data fusion and predictive intelligence platform (SaaS). • tempo.sale — White-label sales infrastructure with VSL engine, CRM, and temporal pricing (SaaS). • penseempregos.com.br — Job portal for SMBs with AI-powered resume parsing. • xcub — Real estate SaaS with auctions, affiliates, and multi-tenant architecture. • Potentius — Autonomous artificial intelligence agent. Services may be offered in free, freemium, or paid subscription models, subject to the specific conditions of each product. AJUDA.DIGITAL reserves the right to modify, suspend, or discontinue any service or feature at any time, with reasonable prior notice when possible.

To access certain services, it may be necessary to create a user account. By creating an account, you agree to: • Provide truthful, complete, and up-to-date information. • Maintain the confidentiality of your access credentials (email and password). • Not share your credentials with third parties. • Immediately notify AJUDA.DIGITAL of any unauthorized use of your account. • Keep your registration data up to date. You are responsible for all activities carried out under your account. AJUDA.DIGITAL is not liable for losses or damages resulting from unauthorized use of your account due to your failure to safeguard your credentials. We reserve the right to suspend or terminate accounts that exhibit suspicious activity, violation of these Terms, or prolonged inactivity, upon notification to the account holder.

All intellectual property rights relating to AJUDA.DIGITAL's services, including, without limitation, source code, algorithms, interfaces, design, texts, trademarks, logos, icons, visual identity, databases, domain names, and other elements, are the exclusive property of AJUDA.DIGITAL LTDA or its licensors, protected by Brazilian intellectual property legislation, including the Copyright Law (Law No. 9,610/1998), the Software Law (Law No. 9,609/1998), and the Industrial Property Law (Law No. 9,279/1996). The User is prohibited from: • Copying, reproducing, modifying, adapting, translating, distributing, transmitting, displaying, reverse-engineering, decompiling, or disassembling any part of the services. • Using AJUDA.DIGITAL's trademarks, logos, or visual identity without prior written authorization. • Removing or altering copyright notices, trademark notices, or other proprietary notices. • Creating derivative works based on the services or their content. Content generated by the User within the platforms remains the property of the User, who grants AJUDA.DIGITAL a non-exclusive, royalty-free, worldwide, and transferable license to use it solely for the purposes of operating, improving, and promoting the services.

When using AJUDA.DIGITAL's services, the User agrees not to: • Violate any applicable law, regulation, or rule, including the LGPD, the Brazilian Internet Framework (Law No. 12,965/2014), and the Consumer Protection Code. • Use the services for unlawful, fraudulent, defamatory, abusive, threatening, obscene, or discriminatory purposes. • Attempt to access restricted areas of systems, other users' accounts, or servers without authorization. • Carry out denial-of-service attacks (DDoS), code injection, phishing, unauthorized data mining (scraping), or any form of vulnerability exploitation. • Disseminate viruses, malware, spyware, or any malicious code. • Intentionally interfere with or overload the service infrastructure. • Use robots, crawlers, or automated tools to access the services without prior written authorization. • Publish false or misleading content, content that violates third-party rights, or content that infringes intellectual property rights. • Resell, sublicense, or commercialize access to the services without authorization. • Create fake accounts or accounts with fraudulent information. Violation of any of these prohibitions may result in suspension or termination of the account, without prejudice to applicable legal measures.

To the fullest extent permitted by Brazilian law: • AJUDA.DIGITAL's services are provided "as is" and "as available," without warranties of any kind, express or implied. • AJUDA.DIGITAL does not warrant that the services will be uninterrupted, error-free, secure, or virus-free. • AJUDA.DIGITAL shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses arising from the use or inability to use the services. • AJUDA.DIGITAL's total liability, under any circumstances, shall be limited to the amount actually paid by the User in the 12 (twelve) months preceding the event giving rise to the claim, or R$ 1,000.00 (one thousand reais), whichever is greater. • AJUDA.DIGITAL is not responsible for third-party content, external links, or third-party services integrated into the platforms. • Results generated by artificial intelligence are informational in nature and do not constitute professional, legal, medical, financial, or any other specialized advice. Nothing in these Terms excludes or limits AJUDA.DIGITAL's liability in cases where such exclusion or limitation is not permitted by applicable legislation, including the Consumer Protection Code.

The User agrees to indemnify, defend, and hold harmless AJUDA.DIGITAL LTDA, its partners, directors, employees, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: • Violation of these Terms or any applicable law or regulation. • Misuse of the services. • Content published or transmitted by the User through the services. • Violation of third-party rights, including intellectual property and privacy rights. • Any dispute between the User and third parties related to the use of the services.

The User may close their account at any time through the platform settings or by sending a request to contato@ajudadigital.com. AJUDA.DIGITAL may suspend or terminate the User's access to the services, in whole or in part, at any time and without prior notice, in the following cases: • Violation of these Terms or product-specific policies. • Conduct that poses a risk to the security, integrity, or availability of the services. • Legal, judicial, or regulatory determination. • Prolonged account inactivity. • Non-payment for paid services, after notification. Upon termination: • The right to access the services will be immediately revoked. • The User's data will be handled in accordance with the Privacy Policy and applicable legislation. • Provisions of these Terms that, by their nature, should survive termination will remain in effect, including intellectual property, limitation of liability, indemnification, and governing law.

These Terms of Use are governed by and construed in accordance with the laws of the Federative Republic of Brazil. For the resolution of any disputes arising from these Terms, the parties elect the jurisdiction of the District of Veranópolis, State of Rio Grande do Sul, Brazil, with express waiver of any other, however privileged it may be. Nothing in this clause shall prevent the User from exercising their rights before the court of their domicile, as provided by the Consumer Protection Code, when applicable.

AJUDA.DIGITAL reserves the right to modify these Terms of Use at any time. Changes will take effect on the date the updated version is published on our websites and platforms. When we make material changes, we will notify you through a prominent notice on the services or by email. Continued use of the services after the publication of changes constitutes acceptance of the new Terms. If you do not agree with the updated Terms, you must cease using the services and, if applicable, request the closure of your account.

• Entire agreement: these Terms, together with the Privacy Policy and any product-specific policies, constitute the entire agreement between the User and AJUDA.DIGITAL. • Assignment: the User may not assign or transfer their rights or obligations under these Terms without prior written consent from AJUDA.DIGITAL. AJUDA.DIGITAL may assign its rights and obligations at any time, including in the event of a merger, acquisition, or sale of assets. • Waiver: the failure or tolerance of either party to require compliance with any provision of these Terms shall not constitute a waiver of the right to require it at any time. • Severability: if any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. • Notices: communications from AJUDA.DIGITAL to the User will be made via the registered email address, notifications on the platforms, or publication on our websites.
